1.Who we are
Zettl is a trading name of Seringa Ltd, a company registered in England and Wales under company number 15449830.
Seringa Ltd operates the Zettl website, tools and services. Any reference to "Zettl", "we", "us" or "our" in these Terms refers to Seringa Ltd acting under its trading name.
These Terms of Use govern your access to and use of the Zettl website, tools, calculators, content and related services (the "Service").
2.Purpose of the Service
Zettl provides calculators, tools and educational resources designed to help individuals understand their property position and explore available options before making decisions.
Zettl does not:
- act as an estate agent or estate agency as defined under the Estate Agency Affairs Act 112 of 1976
- list properties for sale or to let
- negotiate or conclude sale or lease agreements
- provide legal, financial or tax advice
- provide financial advisory or intermediary services regulated under the Financial Advisory and Intermediary Services Act 37 of 2002 (FAIS)
All tools and content are provided for general information and decision-support purposes only and do not constitute professional advice of any kind.
3.Lawful use
You may use the Service only for lawful purposes and in accordance with these Terms.
You agree not to:
- use the Service for any unlawful or fraudulent purpose
- submit false, misleading or inaccurate information
- attempt to disrupt, damage or gain unauthorised access to the Service or its underlying systems
- reproduce, copy or redistribute any part of the Service without prior written permission
4.Accuracy of information
Zettl's tools use calculations based on information you provide and publicly available reference data, including SARS published transfer duty tables, LSSA conveyancing fee guidelines and the South African Reserve Bank's published prime lending rate.
You acknowledge that:
- all outputs are estimates provided for illustrative purposes and are not guarantees
- results are not formal property valuations and do not constitute financial, legal or tax advice
- the accuracy of outputs depends on the accuracy of the information you provide
- you remain solely responsible for any decisions you make based on these tools
- you should consult a qualified property attorney, registered estate agent, or financial adviser before making any property decision
5.Introductions and referrals
The Service is free to use. Zettl may be funded through referral arrangements with property and financial professionals.
Introductions to third-party professionals only occur when you explicitly and separately request to be connected. You are never obligated to proceed with any introduction.
Seringa Ltd may receive a referral fee or other commercial consideration when a consented introduction is made. This does not affect the price you pay for any professional service you subsequently engage.
6.Personal information and POPIA
Seringa Ltd processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Your personal information is collected and used only for the purposes described in our Privacy Policy.
We collect only the information necessary to deliver the Service, including to send you reports you request. We do not sell your personal information to third parties. Your details are only shared with a professional where you have explicitly chosen to connect.
You have the right to access, correct and request deletion of your personal information held by us. To exercise these rights, raise a concern, or withdraw consent, contact us using the details in clause 12.
7.Electronic transactions
Your use of the Service is also subject to the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) to the extent applicable. By using the Service, you confirm that you have read and agree to these Terms, which constitutes a valid and binding agreement in terms of the ECT Act.
8.Intellectual property
All content, tools, code and materials on the Zettl website are owned by or licensed to Seringa Ltd and are protected by applicable intellectual property laws. You may not copy, reproduce, adapt or redistribute any part of the Service without our prior written permission.
9.Limitation of liability
To the fullest extent permitted by applicable law:
- the Service is provided on an "as is" and "as available" basis
- Seringa Ltd makes no warranties, express or implied, as to the accuracy, completeness or suitability of the Service for any particular purpose
- Seringa Ltd shall not be liable for any direct, indirect, consequential or incidental loss or damage arising from your use of or reliance on the Service
Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act 68 of 2008 or any other mandatory South African consumer protection legislation that cannot lawfully be excluded or restricted by contract.
10.Third-party links and services
The Service may contain links to third-party websites or services. Seringa Ltd is not responsible for the content, accuracy or practices of any third-party site and does not endorse any third-party products or services. Accessing third-party sites is at your own risk.
11.Changes to these Terms
We may update these Terms from time to time to reflect changes in the law, our services or our business. Where changes are material, we will update the "Last updated" date at the top of this page. Continued use of the Service after an update constitutes your acceptance of the revised Terms.
12.Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. However, if you are accessing the Service as a consumer ordinarily resident in South Africa, you retain the full benefit of any mandatory rights afforded to you under South African law — including the Consumer Protection Act 68 of 2008 and POPIA — which cannot be excluded or reduced by these Terms.
